Outcome of Disciplinary Hearing

In Ireland, if you face a disciplinary hearing, the outcome can range from no action to warnings (oral, written, final), suspensiondemotion, or dismissal, with fair procedures required, including knowing the allegations, stating your case, and having representation (like a union representative if applicable). 

Possible Outcomes of a Disciplinary Hearing:

  • No further action: The employer finds no grounds for disciplinary action.
  • Warnings: Oral, written, or final written warnings, detailing required improvements.
  • Suspension: With or without pay, pending investigation or as a penalty.
  • Demotion: Transfer to a lower role or section.
  • Dismissal: The most severe outcome, requiring fair grounds and procedures. 
  • The Outcome letter following the Disciplinary Hearing should be issued without delay.

Your Rights During a Hearing:

  • Know the case: Be fully informed of the allegations and evidence against you.
  • Fair hearing: An impartial hearing with a chance to present your side.
  • Representation: The right to be accompanied by a colleague or union representative if applicable.
  • Appeal: An employee should be given the right to appeal the Disciplinary Hearing.
